I don't think anyone in his right mind really believes that the "system," or anyone in it, will force Obama to reveal his trump card until after he's broken the "natural born" clause of the US Constitution. Once the precedent has been established the courts will simply re-interpret (pdf) that clause of their "living" document.
So it seems simple to me: one way to get this birth certificate issue before a federal judge is for someone to directly disobey a clear order of the next Commander-In-Chief.
Someone, somewhere, will be in a position to perform an act of insubordination on the basis that BHO is an illegitimate pretender to the highest office in the USA.
The only problem with that is that Joe Biden will inherit the office.

I understand and agree, but even if they rule on the 5th it's not a guilty/not guilty verdict.
ReplyDeleteSouter has only required Obama or his agents to show cause why the SCOTUS should not (or ask a lower court to) accept an action based on the missing confirmation.
If delays are sought and granted, history shows that it could be January 22, 2009, before he could rule. And then he could rule the issue is moot because Obama has already been inaugurated.
