GWOT Leftists have a new global "rule of law"; fanatics are using the breach to full advantage!

I spend quite a bit of time at The Brussels Journal these days. The writing and the righting are both excellent. In fact, they're under consideration for The CRIB's next "Double E Award".

This morning's post by George Handlrey is an excellent and logical look at the Left's hypocritical and oxymoronic take on captured insurgents/soldiers/revolutionaries/freedom-fighters being held by the US in Cuba. The money quote follows ...
When it is to the advantage of fighting armed Islamists they are "soldiers." When in the course of their actions they systematically and by policy fight by ignoring the rules of warfare, humanism and decency they are, as civilian insurgents not bound by these or any other rule they care to violate.

Once these fanatics, who have, by word and deed repudiated civilization are captured, they are again to be considered as soldiers. As such they are protected by the international law on warfare and by the due process rules of the (otherwise despised) Americans.

This state of affairs makes one close the exposition with two propositions. The first one: you can have it both ways but only by getting away with it if opposed by fools and not by right. Second: "due process" might just be the process that is due because it is deserved.
I believe Handlery means by the latter that Bush may find the "Ace in the Hole" he is looking for by going the way of criminal justice rather than military justice, because he will steal away the "soldier" argument for the radicals. After all that is what democracies do "according to their" beliefs.
