JUDICIAL DYSFUNCTION - Are judges to be hypocrits?

This year we learned at least three Supreme Court justices (Bryer, Kennedy & O'Conner) have used international law or the decisions of foreign courts to arrive at their decisions, citing them in their written opinions.
But in Nebraska, a state growing increasingly left of center in the great "red state" swath, a state senator is suing to keep judges from using the Bible in their decisions ...

A Nebraska state senator has filed a complaint against a judge whose religious comments have caused the sentences of two child molesters to be overturned.

In September, the Nebraska Court of Appeals vacated the prison sentence of a former school bus driver who sexually assaulted a child on his bus. The court based its decision on the fact that Judge George Thompson made references to the Bible before sentencing.

In 1998, the Nebraska Supreme Court overturned the sentence of another man charged with sexually molesting a 13-year-old boy because Thompson read a lengthy excerpt from the Bible that addressed homosexuality at the man's sentencing. In a complaint filed with Nebraska's Commission on Judicial Qualifications, State Senator Ernie Chambers said Judge Thompson is guilty of willful misconduct in office. [AP]

It gets more and more confusing and frustrating in this world of secular wisdom; the more secularlist humanists get their way, the more the fruits of their decisions and philosophies of life come back to bite normal Americans in the posterior.
