... when we can taste the pudding! John Roberts, Chief Justice nominee for SCOTUS, ...
declined to say on Tuesday if he would reverse the long-standing decision legalizing abortion but said he believed the Constitution accorded Americans the right to privacy, the key underpinning of the landmark ruling.I've been thinking about the nominations and confirmations process for SCOTUS; I've decided only God knows!
The reason we won't know (what his hairdresser doesn't even know) is that is welded to our need for an independent judiciary; one which is free to consider the merits of each case under the law. Candidates, good or bad, who would do otherwise should be disqualified if they fail at that point. They must refrain from revealing how they will decide ... for the sake of the law and for the sake of defendants and claimants, whichever.
And so that is why we end up with conservative presidents being responsible for really bad justices who make bad decisions. We can't know till we taste the pudding; neither can they!
